General Terms & Conditions

These General Terms and Conditions apply to all contracts between Buzzidil GmbH (below „Buzzidil“) and the customers.

1.     Conclusion of contract

The display of goods for sale in the online shop is not a binding offer.

By completing the technical order process and clicking the "purchase" button the customer makes a binding offer for a sales contract regarding a Buzzidil baby carrier or another product of the Buzzidil online shop (for example 3-Way-Bag, rain cover, sun cover, doll carrier etc).

Buzzidil accepts this offer by delivering the ordered goods to the customer. The order confirmation is sent automatically. It is not a declaration but an automated information for the customer concerning the receipt of the binding offer only.

The contractual goods are reserved for payment for 7 days after placement of the binding order of the customer. In case payment is not effectuated within this term Buzzidil considers the offer of the customer as withdrawn and provides the objective goods in the online shop again.

2.     Technical Order Steps

1. Customer chooses a product from the Buzzidil online-shop and clicks „add to cart“.

2. Customer clicks the button „proceed to check out“.

3. Customer indicates his billing and shipping information

4. Customer chooses the shipping method (DPD, Post AG). Based on the information given by customer the exact dispatch costs are determined.

5. Customer chooses the payment method.

6. Customer agrees to the general terms and conditions and confirms the information of withdrawal.

7. Subsequently an order overview is shown also indicating shipment costs and if PayPal was choosen PayPal fees.

8. Customer finalizes his order by clicking the button „Place Order“.

Customer can correct his order before clicking „Place Order" (see sec 8. above) by using the „Change“-buttons on the right side of the order side, by using the „back“-buttons, as well as by directly clicking the control fields (billing information, shipping information, shipping method, payment information).

After finishing the order procedure (1.-8.) customer receives an automated order confirmation including all order details.

3.     Payment

Prices indicated on the website include 20% VAT. These prices do not include postage fees and packaging costs.

Payment can be made by bank transfer or via PayPal or credit card in advance.

In the case of an agreed pickup by the customer in the Vienna Buzzidil office the price may be paid cash (delivery versus payment).

The corresponding postage and packaging costs will be added to the purchasing prices. Any charges for the bank transfer have to be paid by the customer.

4.     Delivery

In case of payment per bank transfer dispatch of the ordered goods is effectuated within 2-4 working days after receipt of payment. Dispatch is effectuated according to your choice by means of GLS or post.at (Austrian national post).

Please note that – depending on the shipping method choosen by customer and the shipping address the duration of dispatch varies, which cannot be influenced by Buzzidil.

Orders being dispatched within Austria are free of dispatch charges in case that GLS is choosen as shipping method and the invoice sum exceeds EUR 120. 

5.     Right of Withdrawal for EU-Consumers

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us (Buzzidil GmbH, Gaudenzdorfer Gurtel 43-45 / 0C, 1120 Vienna, Austria, Email: office@buzzidil.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods

Please note:

Please return goods only in parcels that can be tracked, so that in the event, that a parcel is lost, it can be found again. Please understand, that we cannot take over parcels being sent on our costs (carriage forward).

When returning just part of the delivery the part of delivery costs that ocurred together with this part will be reimbursed. 

There is no right of withdrawal for customized products.

There is no right of withdrawal for retailers or babywearing instructors or other customers not being EU-consumers.

6.     Warranty, Customer Service, Online Dispute Resolution

Warranty applies for the legal period of 2 years and according to the statutatory rules.

Please contact us per email to office@buzzidil.com. In case it is not possible to repair the carrier, we will replace it. Please understand, that the warranty rules apply to defects in being at delivery of the babycarrier only.

Warranty rules do not apply to damages occuring after delivery – please contact us in such cases per email to office@buzzidil.com so that we can find a solution.

7.     Data Protection

Buzzidil uses data indicated by users (name, address, email address, ev telephone number) for the execution of orders. 

8.     Regulations for Retailers and Babywearing Instructors

In case customer is not a consumer, the following provisions enter into force in addition or in alteration of the provisions above.

8.1 Registration

Retailers / Babywearing instructors registrate as customer in the online-shop (http://shop.buzzidil.com) and subsequently submit a scan of their  trade licence or education certificate per email (office@buzzidil.com). In order to transact tax exempt intra community deliveries a VAT-number has to be indicated.

After submission of trade licence scan or education certificate the customer account can be activated as retailer’s / babywearing instructor’s account. Retailers‘/instructors‘ prices are only available after such activation of the customer’s account. Please understand that activation might take 1 – 2 working days. Please do not order before activation as then the order is placed at consumers‘ prices.

8.2 Conclusion of Contract

By completing the technical order process and clicking the "purchase" button the retailer/babywearing instructor makes a binding offer for a sales contract. Buzzidil accepts this offer by delivering the ordered goods. The order confirmation is sent automatically. It is not a declaration but an automated information for the customer concerning the receipt of the binding offer only.

Orders are processed in the order of their arrival. There is no guarantee with regard to the availability of certain products.

8.3 Part Orders

Please note: every order placed over the online-shop is an offer that is leading to a contract when accepted by Buzzidil. For every order shipment costs arise. The placement of part orders is possible but leads to different contracts.

The pooling of orders is in general not possible but only in absolutely exceptional cases.  A sumarization of part orders is in such cases limited to 2 orders placed on the same day. Buzzidil reserves the right to invoice fees for the summarization of orders (minimum fee EUR 15).

8.4 Prices

Prices are according to the current price list (indicating the prices excl. VAT and excl shipment costs). However, the prices indicated in the online-shop are incl VAT.

8.5 Payment

Delivery is made after receipt of payment / of a payment confirmation. In case that there is no payment within 7 days, the order is deemed invalid (dissolving condition) and the goods can be sold to other customers.  

When using payment modules instead of bankwire transfer the fees of payment providers (like PayPal or kredit card companies) are invoiced to the customer. When making bankwire transfers please make sure that all payment fees have to be taken over by the customer. 

8.6 No Right of Withdrawal, Warranty, Choice of Law, Place of Jurisdiction

Retailers and instructors do not have a right of withdrawal (point 5.)

Warranty is limited to 6 months after delivery. Identifiable defects shall be reprehended per email to office@buzzidil.comimmediately i.e. within three working days.

For the contract between Buzzidil and retailers/instructors only these general terms and conditions are in force. General terms and conditions of retailers/instructors are not valid for this contract.

The parties of contract agree on the Austrian laws. The parties agree on exclusive juristiction before the courts of Austria, Vienna, 1st district.

9.     Final Clauses

Contractual and other declarations can be made tot he email-address indicated by the customer and are deemed to be well received. 

Until complete payment all goods ordered remain in the ownership of Buzzidil.

The Buzzidil babycarrier is protected as patent at the Austrian Patent Office. Please note, that the use or copy of the Buzzidil babycarrier or protected parts thereof will be prosecuted before court.

Please note that Buzzidil also is a registered trademark.

All pictures, logos, fotos and texts on this website are protected by copyright law and may only be used after previous explicit consent of Buzzidil.

In case that some regulations of these general terms and conditions do not apply in some jurisdictions this does not affect the validity of other regulations.
